Building on our globally-leading expertise in the energy and natural resources field, our LL.M. (and associated certificate and diploma) in International Dispute Resolution and Management is the logical next step in our effort to understand and explain the resources industry with an international and inter-disciplinary perspective and as a continuous process of negotiations, dispute management and settlement activities. The programme aims to educate students in the theory and practice of international dispute management, from its causes to its consequences, from prevention to management to settlement.

This specialisation provides an intellectually challenging academic programme of study, which will enable the student to analyse, synthesise and evaluate key theoretical concepts of dispute settlement/management in international business transactions and their practical applications, with a particular focus on the natural resources and energy industries.

The core courses for the specialisation are designed with a view to preparing participants for legal, managerial and/or advisory positions in both the private and public sectors involving international business transactions in the natural resources sector.

The programme will provide students with the ability to:

  • recognise potential disputes; mitigate risk of disputes through the implementation of well drafted dispute resolution clauses and make use of the various formal and alternative dispute resolution mechanisms available;

  • administer and manage current and future disputes to the best economic interest of the relevant parties;

  • recognise and select the most appropriate dispute settlement mechanism, forum, seat, and governing law available; and to be able to negotiate effectively for its implementation; and

  • critically review and analyse information relating to the international energy and natural resources sectors, informed by developments at the forefront of the subject.

And the skills to:

  • draft dispute resolution clauses in international contracts and/or agreements in a manner that best serves their interests and taking into consideration the latest developments in the field;

  • promptly identify dispute resolution clauses in existing international contracts and/or agreements so as to better appreciate potential areas of dispute and take prompt action as appropriate;

  • weigh the position of the parties at any point in the evolution of a dispute on the basis of the options available under the relevant dispute resolution clauses and take prompt action with a view to maximising the interest of the party concerned.
